On 23 April 2026, the Regional Court in Prešov ruled in the case of three Roma children who had been educated in special classes. The court returned the case to the District Court for further proceedings, as the expert evidence needs to be properly assessed, which, according to the Supreme Court, had not been sufficiently taken into account in the previous proceedings.

The Regional Court also confirmed that the District Court’s original conclusions were correct and supported by the evidence. It again pointed to the problematic nature of the original diagnosis on the basis of which the children were placed in special education. Subsequent psychological examinations and expert assessments did not confirm an intellectual disability. According to the Regional Court, even the disputed expert report does not undermine these findings; on the contrary, it supports them.

The case will now be reconsidered by the District Court.
