Judgment of the Municipal Court Bratislava IV in the case of segregation of Roma children at the primary school Stará Ľubovňa – Podsadek

The Municipal Court of Bratislava IV, by its judgment of 7 May 2024, did not oblige the defendant State, represented by the Ministry of Education and the town of Stará Ľubovňa to eliminate the segregation of Roma children at the primary school in the locality of Stará Ľubovňa – Podsadek. Our NGO has been conducting strategic court proceedings in this case since 2015. The segregation at this school has already been finally decided by the Supreme Court of the Slovak Republic in December 2022. The Municipal Court has only ruled on the part of the lawsuit we are seeking to remedy the illegal situation at that school. The decision is not final and will appeal it.

Judgment of the Municipal Court Bratislava IV in the case of segregation of Roma children at the primary school in Muránská Dlhej Lúka

The Municipal Court of Bratislava IV, by its judgment of 21 May 2024, did not oblige the defendant State, represented by the Ministry of Education, to eliminate the segregation of Roma children at the primary school in the village of Muránska Dlhá Lúka. Our NGO has been conducting strategic court proceedings in this case since 2015. The segregation at this school has already been finally decided by the Supreme Court of the Slovak Republic in July 2023. The Municipal Court has only ruled on the part of the lawsuit we are seeking to remedy the illegal situation at that school. The decision is not final and will be appealed.

Judgment of the Regional Court in Prešov on the segregation of Roma children from Malý Slivník at the primary school in a village Terňa

The Regional Court in Prešov, in its judgment of 22 April 2024, confirmed that the defendant state institutions had committed discrimination – both by adopting decisions on the designation of the school district, which maintained the existing segregation of Roma children at the school in Terni, and by failing to take effective measures to prevent and eliminate their segregation. The Regional Court upheld the defendants’ obligation to develop within six months of the judgment, a plan of measures leading to the effective elimination and prevention of segregation and their obligation to implement that plan within two years. The decision is final and the defendants cannot appeal against it.

The judgment of the European court of human rights concerning the police raid in Roma community in Vrbnica

The European Court of Human Rights (ECtHR), in its judgment in the case of T.K and Others v. Slovak Republic of 5 March 2024, took note of a friendly settlement between the Government of the Slovak Republic and three Roma who faced violence during a police raid in Vrbnice in 2015. The friendly settlement was reached on the initiative of the Court, which called on the parties to settle out of court, also referring to its judgment in the 2020 Moldava nad Bodvou police raid case. The complaining Roma were represented by a lawyer cooperating with our NGO.

Judgment of the District Court in Prešov in the case of the digital divide and access to education

The District Court in Prešov, by a judgment from 6 November 2023, ruled in the case of a Roma child who had no access to education during the Covid-19 pandemic due to limited internet access and digital technologies. A Roma girl from a disadvantaged community in Jarovnice sued the Ministry of Education, which failed to provide her with equal access to online distance education during the Covid-19 pandemic. Poradňa provided her with free legal representation in the court proceedings. The court upheld the claim and awarded damages in the full amount of €3,000. This is the first judgment of its kind not only in Slovakia, but also in Europe, which has highlighted the disadvantages in access to digital technologies and the internet faced by some groups in Slovak society, which are of a wider systemic nature.
