The Regional Court in Prešov, in its judgment of 28 February 2023, confirmed the judgment of the District Court in Prešov, which had decided in November 2021 that the defendants – the Private Centre for Special Pedagogic Counselling in Prešov and the primary school in Hermanovce had discriminated against three Romani children who were illegally educated at the defendant school in special classes for children with mild intellectual disabilities. Moreover, unlike the first instance court, the appelare court also upheld the liability of the State, represented by the Ministry of Education, which had failed to take effective preventive measures to protect the aggrieved children from discrimination and to eliminate it.
