On 15 December 2022, the Supreme Court of the Slovak Republic upheld the appeal of our NGO against the judgment of the Regional Court in Bratislava, which in April 2016 upheld the judgment of the first instance, which in December 2016 dismissed the public lawsuit initiated under the Anti-Discrimination Act against the Slovak Republic represented by the Ministry of Education and the town of Stará Ľubovňa. The Supreme Court ruled that by educating Roma children in an ethnically homogeneous school close to the local disadvantaged Roma community, they are discriminated against on the basis of their ethnicity. In doing so, it confirmed the responsibility of the defendant State, represented by the Ministry of Education, and the town of Stará Ľubovňa as the school’s founder, which, according to the Court, had failed to take sufficient preventive measures to eliminate the discrimination against Roma children in question.
